2.1 Personal Information

For purposes of this Policy, "Personal Information" means information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device.

Personal Information does not include publicly available information lawfully made available from government records, deidentified or aggregated information, or information excluded from the scope of applicable privacy laws.

2.2 Sensitive Personal Information

"Sensitive Personal Information" means a subset of Personal Information that includes (where applicable under California, Virginia, Colorado, Connecticut, or other state privacy laws): government identifiers (Social Security number, driver's license number, passport number); financial account information combined with access codes; precise geolocation; race or ethnic origin; religious beliefs; union membership; mail, email, or text message contents not directed to us; genetic data; biometric data; health information; sexual orientation or sex life information.

2.3 Consumer

"Consumer" means a natural person residing in a U.S. state with applicable privacy laws (including California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Tennessee, Indiana, Delaware, New Hampshire, New Jersey, Maryland, Minnesota, and Rhode Island).


3. PERSONAL INFORMATION WE COLLECT

In the preceding twelve (12) months, we have collected the following categories of Personal Information from consumers, organized according to the categories enumerated in the California Consumer Privacy Act (Cal. Civ. Code §1798.140):

3.1 Identifiers

Name, postal address, email address, phone number, IP address, account name, customer ID, online identifiers, device identifiers, cookies and similar tracking technologies.

3.2 Customer Records (Cal. Civ. Code §1798.80(e))

Billing address, shipping address, payment method information (such as last 4 digits of credit card, card type, expiration date — full payment card numbers are processed by our payment processors and not retained by us), purchase history.

3.3 Commercial Information

Records of products purchased, returned, or considered; subscription enrollment status; transaction history; promotional codes used; refund and cancellation history.

3.4 Internet or Other Electronic Network Activity Information

Browsing history on our Website, search history on our Website, page views, clicks, time on page, scroll depth, referring URL, exit pages, interactions with advertisements, interactions with our SMS or email communications, device type, operating system, browser type and version, screen resolution, language preferences.

3.5 Geolocation Data

Approximate location derived from your IP address (city, state, country level). We do not collect precise geolocation data (latitude/longitude with radius narrower than 1,850 feet).

3.6 Audio, Electronic, Visual, or Similar Information

Customer service correspondence (email and chat transcripts); content of voice or video messages you send to us; any photographs or videos you submit (such as for refund claims, product reviews, or testimonials).

3.7 Inferences

Profiles reflecting your preferences, characteristics, predispositions, behavior, and attitudes, derived from any of the above information, used for marketing personalization and product recommendation.

3.8 Sensitive Personal Information (Limited Collection)

We do not intentionally collect Sensitive Personal Information. To the extent customers voluntarily disclose health-related information (such as skin conditions, allergies, or pregnancy/nursing status) in connection with a refund claim or product inquiry under our Refund Policy, we process such information solely for the purpose of evaluating the request and not for inferring characteristics about the consumer.


4. SOURCES OF PERSONAL INFORMATION

We collect Personal Information from the following sources:

  • Directly from you: when you create an account, place an order, subscribe to a Subscription Service, contact customer service, opt into email or SMS marketing, complete a quiz or survey, submit a product review, or otherwise interact with the Website;
  • Automatically: through cookies, pixels, web beacons, server logs, and similar tracking technologies when you visit the Website (see Section 7);
  • From third parties: from our advertising partners (such as Meta and TikTok), analytics providers (such as Google), payment processors (such as Adyen, Checkout.com, Payarc/Evolve, and Shopify Payments), shipping carriers, our subscription management platform (Loop Subscriptions), our email/SMS marketing providers (Klaviyo, Postscript), our customer service platform (Zendesk), fraud prevention services, and your social media accounts (when you choose to interact with us through them).

5. PURPOSES FOR WHICH WE COLLECT AND USE PERSONAL INFORMATION

We use Personal Information for the following business and commercial purposes:

5.1 To Provide Our Services

To process orders, fulfill subscriptions, ship products, manage your account, process payments, calculate taxes and shipping fees, communicate order status, and perform our contract with you.

5.2 To Communicate With You

To send order confirmations, shipping notifications, subscription reminders (including the pre-renewal notification described in Section 5 of our Subscription Policy), customer service responses, and (where you have opted in) marketing communications via email and SMS.

5.3 To Personalize Your Experience

To tailor product recommendations, display relevant content, remember your preferences, and improve your interactions with the Website.

5.4 For Marketing and Advertising

To deliver targeted advertising on third-party platforms (Meta, TikTok, Google, and similar networks), measure advertising performance, conduct retargeting campaigns, and create lookalike audiences. See Section 11 for details on cross-context behavioral advertising.

5.5 For Analytics and Improvement

To analyze usage patterns, measure conversion rates, conduct A/B testing, identify technical issues, and continuously improve our Website, products, and services.

5.6 For Security and Fraud Prevention

To detect, investigate, prevent, and respond to fraud, abuse of our promotional offers, fraudulent chargebacks, security incidents, malicious activity, and violations of our Terms and Conditions, Refund Policy, or Subscription Policy.

5.7 For Legal and Compliance Purposes

To comply with applicable laws, regulations, court orders, governmental requests, tax obligations, and the rules of payment card networks (Visa, Mastercard, American Express, Discover); to enforce our agreements; to defend against legal claims; and to participate in arbitration or litigation as set forth in our Terms and Conditions.

5.8 For Business Operations

To maintain financial records, conduct internal audits, manage corporate transactions (mergers, acquisitions, asset sales), and exercise legitimate business interests.

  • Subscription management: Loop Subscriptions — Subscription enrollment, renewals, cancellations, and customer portal;
  • Email marketing: Klaviyo, Inc. (225 Franklin St, Floor 10, Boston, MA 02110, USA) — Transactional and marketing emails;
  • SMS marketing: Postscript (or successor SMS provider) — Transactional and marketing text messages;
  • Customer service: Zendesk, Inc. (989 Market Street, San Francisco, CA 94103, USA) — Ticket management, email and chat support;
  • AI customer service agent: Commslayer (operating our "Sofia" AI agent) — Automated customer service, retention, and cancellation flows;
  • Payment processors: Shopify Payments (operated by Shopify Inc., 1 Toronto Street, Toronto, ON, Canada, with payment processing services provided through Stripe, Inc. and other underlying processors) is our current primary payment processor. We may also engage one or more additional or alternative third-party payment processors from time to time (which may include, without limitation, Adyen, Checkout.com, Payarc/Evolve Bank & Trust, Braintree, PayPal, or successor services), at our sole discretion and without prior notice to you. Personal Information shared with payment processors is limited to information necessary to process the transaction;
  • Fulfillment and logistics: Infinite Fulfillment / 8LS Limited, Yun Express, USPS, UPS, FedEx, DHL, and other carriers — Order fulfillment and shipping;
  • Chargeback management: Chargemont UAB and similar fraud prevention services;
  • Analytics: Google LLC (Google Analytics 4), and similar analytics providers — Website usage analysis;
  • Tag management: Google Tag Manager — Website code management;
  • Quiz and survey tools: Visual Quiz Builder (VQB) and similar — Customer quiz funnels;
  • Hosting and infrastructure: Cloudflare, Amazon Web Services, and similar — Technical infrastructure.

6.2 Advertising Partners

Companies that operate advertising platforms on which we display advertising:

  • Meta Platforms, Inc. (1 Hacker Way, Menlo Park, CA 94025, USA) — Facebook, Instagram, Messenger, WhatsApp advertising; Meta Pixel; Conversions API; lookalike and custom audiences;
  • TikTok Inc. — TikTok advertising; TikTok Pixel;
  • Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) — Google Ads; Display Network; YouTube;
  • Other advertising partners as added from time to time.

6.3 Affiliates and Corporate Group

Affiliated companies under common ownership or control with LKS LLC, including operating brands such as Chinology, Cellôa, Flavi, Woofy, AllDry, Alltone, Noxelya, and Glowea, where sharing is consistent with this Policy.

6.4 Legal and Government Authorities

Law enforcement, regulators, courts, and government agencies, where required by law, court order, subpoena, or where we believe in good faith that disclosure is necessary to comply with legal obligations, protect our rights or property, prevent fraud, or protect the safety of any person.

6.5 Professional Advisors

Lawyers, accountants, auditors, insurers, and other professional advisors, under appropriate confidentiality obligations.

6.6 Successors in Interest

In the event of a merger, acquisition, reorganization, sale of assets, bankruptcy, or other corporate transaction, Personal Information may be transferred to the successor entity, subject to the protections of this Policy.


7. COOKIES AND TRACKING TECHNOLOGIES

7.1 Categories of Cookies and Trackers Used

We use the following categories of cookies, pixels, web beacons, and similar tracking technologies:

  • Strictly Necessary: Required for the Website to function (cart, checkout, login). Cannot be disabled.
  • Functional: Remember your preferences (language, currency, viewing history).
  • Analytics: Measure Website usage, identify popular pages, monitor performance (Google Analytics 4, Shopify Analytics, Triple Whale or similar).
  • Advertising and Targeting: Track your activity across websites to show you relevant advertising (Meta Pixel, TikTok Pixel, Google Ads conversion pixel, retargeting pixels).

7.2 Cookie Management

Disabling certain cookies may limit your ability to use some features of the Website.

7.3 Do Not Track Signals

Our Website does not currently respond to "Do Not Track" browser signals. We do, however, honor Global Privacy Control (GPC) signals as described in Section 20.


8. RETENTION OF PERSONAL INFORMATION

We retain Personal Information only for as long as necessary to fulfill the purposes for which it was collected, unless a longer retention period is required or permitted by law. Specific retention periods include:

10. SALE OR SHARING OF PERSONAL INFORMATION

10.1 No Sale of Personal Information

We do not sell Personal Information in exchange for monetary consideration.

10.2 Sharing for Cross-Context Behavioral Advertising

Under the broad definition of "sharing" under the California Consumer Privacy Act (as amended by the CPRA) and equivalent laws in other states, our use of advertising cookies and pixels (including the Meta Pixel, TikTok Pixel, and Google Ads conversion pixel) may constitute "sharing" of Personal Information for cross-context behavioral advertising purposes.

The categories of Personal Information shared in this manner include:

  • Identifiers (cookie IDs, device IDs, hashed email);
  • Internet or other electronic network activity (page views, conversions);
  • Inferences derived from the above.

10.3 Your Right to Opt Out of Sharing

You have the right to opt out of the sharing of your Personal Information for cross-context behavioral advertising purposes. To exercise this right, you may:

  • Use the "Do Not Sell or Share My Personal Information" link in our Website footer;
  • Send your opt-out preference signal via Global Privacy Control (GPC), which we will honor as described in Section 20;

We will process opt-out requests within fifteen (15) business days as required by California law.

We engage in cross-context behavioral advertising and targeted advertising to display relevant Chinology advertisements to you on third-party websites and platforms (including Facebook, Instagram, TikTok, and Google).

You may opt out of:

  • Meta advertising at https://www.facebook.com/settings/?tab=ads;
  • TikTok advertising in your TikTok account settings;
  • Google advertising at https://adssettings.google.com;
  • Industry-wide opt-out at the Network Advertising Initiative (NAI) at https://optout.networkadvertising.org or the Digital Advertising Alliance (DAA) at https://optout.aboutads.info.

For California, Colorado, Connecticut, Virginia, and other state residents, you may also exercise your statutory right to opt out as described in Sections 10 and 13.


12. YOUR PRIVACY RIGHTS — CALIFORNIA RESIDENTS (CCPA/CPRA)

12.4 Right to Opt Out of Sale or Sharing

12.5 Right to Limit Use of Sensitive Personal Information

You have the right to limit the use and disclosure of Sensitive Personal Information to uses necessary to provide the requested goods or services. As stated in Section 3.8, we do not intentionally collect Sensitive Personal Information for purposes beyond what is necessary to perform our contract with you.

12.6 Right to Non-Discrimination

We will not discriminate against you for exercising your privacy rights. We will not deny you services, charge different prices, provide different quality, or suggest you will receive different services for exercising your rights.

12.7 Shine the Light (California Civil Code §1798.83)

California residents who have an established business relationship with us may request, once per calendar year, information about Personal Information shared with third parties for those third parties' direct marketing purposes during the preceding calendar year. To make such a request, email info@us-chinology.com with the subject "Shine the Light Request."


13. YOUR PRIVACY RIGHTS — OTHER U.S. STATE RESIDENTS

If you are a resident of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Tennessee, Indiana, Delaware, New Hampshire, New Jersey, Maryland, Minnesota, Rhode Island, or any other state with comparable comprehensive privacy laws, you may have the following rights, subject to the specific requirements and exceptions of your state's law:

  • Right to delete Personal Information;

At or before the point of collection of Personal Information, we collect the categories of Personal Information identified in Section 3, for the business purposes identified in Section 5, and may share Personal Information with the categories of third parties identified in Section 6. We retain Personal Information for the periods set forth in Section 8.

16.3 Response Timeframes

We will acknowledge receipt of your request within ten (10) business days and substantively respond within forty-five (45) calendar days, with a possible 45-day extension where reasonably necessary, in compliance with applicable privacy laws.

For opt-out of sale or sharing requests, we will process within fifteen (15) business days as required by California law.


17. VERIFICATION OF IDENTITY

To protect your information, we will verify your identity before responding to any request. Verification typically involves matching information you provide in the request with information we have on file (such as your email address, order number, or other account details). For sensitive requests, we may require additional verification.

If we cannot verify your identity, we may deny the request and notify you of the denial.

20. GLOBAL PRIVACY CONTROL (GPC) AND OPT-OUT PREFERENCE SIGNALS

We honor opt-out preference signals sent by your browser through Global Privacy Control (GPC) and similar opt-out mechanisms recognized under California, Colorado, and Connecticut privacy laws.

When we detect a valid GPC signal from your browser, we will treat it as a request to opt out of the sale or sharing of your Personal Information and the use of your information for targeted advertising. 21. CHILDREN'S PRIVACY

21.1 Under Age 13 (COPPA)

Our Website and Services are not directed to children under thirteen (13) years of age. We do not knowingly collect Personal Information from children under 13. The Website may contain links to third-party websites, applications, and services (such as Meta, TikTok, Google, payment processors, and shipping carriers) that are not operated or controlled by us. This Privacy Policy does not apply to those third parties. We are not responsible for the privacy practices of any third party. We encourage you to review the privacy policies of any third-party services you use.


23. DATA BREACH NOTIFICATION

In the event of a data breach affecting your Personal Information, we will notify affected individuals and applicable regulatory authorities as required by applicable U.S. federal and state breach notification laws.

Notification will be provided without undue delay following discovery of the breach and will include, where applicable, a description of the breach, the categories of Personal Information affected, the steps you can take to protect yourself, and the steps we have taken in response.
